Official Rules For The Flip UltraHD™ camcorder
 
No purchase or payment of any kind is necessary to enter or win this sweepstakes.

1.

How to enter:  The The Flip UltraHD™ camcorder raffle begins at 12:00 a.m. (EST). July 1, 2010 and ends at 11:59 pm (EST) on August 31, 2010. To enter, just fill out the online entry form with your name, address and telephone number and submit, you may enter the raffle at www.stmarysbank.com/giveaway. By entering, entrants agree to be bound by and acknowledge compliance with these official rules including eligibility requirements. Responsibility for receipt of entry rests solely with the entrant. All entries become the property of the Sponsor. Sponsor will not be responsible for lost, misdirected or for technical, hardware or software malfunctions, telephone failures, lost or unavailable network connections, or failed, inaccurate, incomplete, garbled or delayed electronic communications, or for any human or mechanical error that may occur in the processing of the entries in this Sweepstakes. Sponsor reserves the right to cancel the Sweepstakes in Sponsor’s sole discretion. Sponsor will not acknowledge receipt of entries. All disputes shall be settled in the sole judgment of the Sponsor.

Eligibility:  To enter the Sweepstakes, you must be a lawful permanent resident of the United States and be 18 years of age or older to be eligible for drawing. Employees and volunteer officials of St Mary's Bank, as well as immediate family of any employee (spouse, mother, father, sister, brother, daughter, or son) or member of the same household (whether related or not) of any employee are not eligible to win. Must be 18 years of age or older. Limit one entry per person. This offer is void where prohibited and subject to all federal, state and local laws and regulations.

Drawing and Notification: Drawing will be held on or about September 7, 2010 at 200 Bedford Street, a random drawing will be conducted by Sponsor and 1 winner from the pool of eligible entries will be drawn. The pool of entries consists of all eligible entry forms received which originated from St. Mary’s Bank’s website. Odds of winning a prize depend on the number of eligible entries received in the entry pool. Potential winners will be notified by phone, email or mail. If potential winner does not claim the prize within ten (10) days from first notification attempt, then such person shall forfeit the prize and shall be disqualified and an alternate winner will be selected from the remaining pool of entries. All prizes will be awarded. Winnings may be reported to the Internal Revenue Service for tax purposes as required by law. Prize will not be awarded until the Affidavit and Release forms are completed. Failure of the winner to execute the Affidavit and Release forms within the specified time period may result in winner's forfeiture of the prize and selection of an alternate winner(s) from remaining eligible entries. By accepting any prize, winners consent to the use of their names, voices, and likenesses for promotional, advertising, publicity or trade purposes in any and all media worldwide in perpetuity by Sponsor without further compensation unless otherwise prohibited by law.

Prize: The Flip UltraHD™ camcorder – approximate value is: $179.99. All federal, state, and local taxes, and all other expenses not specifically mentioned herein are the sole responsibility of the winner. Sponsor reserves the right to substitute color, size, options and model based on availability at the time of a Prize being awarded.

Prize Conditions: All federal, state or other tax liabilities (including income taxes) arising from this sweepstakes will be the sole responsibility of the winner. Except where prohibited by law, the winner's entry and acceptance of the prize constitutes permission for the sweepstakes entitles to use said winner's name, photograph, likeness, statements, biographical information and voice on a worldwide basis, in all forms of media without further compensation.

Sweepstakes Conditions:  This sweepstakes is subject to all applicable federal, state and local laws. By participating entrants agree to be bound by these official rules and the decision of the sponsor and waive any right to claim ambiguity in the Sweepstakes or these Official Rules. Sponsor may prohibit an entrant from participating in the Sweepstakes or winning a prize if, at its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, deception or unfair playing practices or intending to annoy, abuse, threaten or harass any other entrants or Sponsor representatives. If for any reason this sweepstakes is not capable of running as planned, including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention, fraud or any other causes beyond the reasonable control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the promotion, then the sponsor reserves the right at its sole discretion to cancel the online entry portion of the sweepstakes and to award all prizes by conducting a random drawing from all eligible mailed entries received. Any person attempting to defraud or in any way tamper with the Sweepstakes will be ineligible for prizes and may be prosecuted to the full extent of the law.

Limitations of Liability:  By participating in this Sweepstakes, Winner and entrants agree to release, discharge, indemnify and hold harmless the Sweepstakes Entities and each of their respective officers, directors, employees, representatives and agents from and against any claims made by the winner, entrants or any other third parties related in any way to the development or operation of this sweepstakes, as well as any other claims, damages or liability due to any injuries, damages or losses (whether alleged, threatened, or actual) to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any sweepstakes-related activity or participation in this sweepstakes.
