Official Rules for August 11, 2019 Red Sox Tickets
To enter the St. Mary’s Bank Red Sox Tickets Sweepstakes (the “Sweepstakes”), you must agree to and abide by the following rules (these “Official Rules”).
No purchase, obligation, or enrollment necessary to enter or win.
Sponsor: St. Mary’s Bank, 200 McGregor Street, Manchester, NH 03102 (“Sponsor”).
Consumer Disclosures:
Prize: One (1) winner of the Sweepstakes will receive four (4) tickets (State Street Pavillion Club, section 13, row 1, seats 3–6) to the August 11, 2019 Red Sox game at 1:05 pm EDT at Fenway Park, Boston, MA (the “Prize”).
Approximate Retail Value of the Prize: $760.00
Odds of Winning: Depend on the number of eligible entries received in the entry pool at the time of drawing.
Additional Terms and Costs: Transportation to and from the game, parking, and lodging are not included. Sponsor will not replace any lost or stolen tickets. Tickets are subject to additional rules and restrictions as stated on the tickets. All federal, state, and local taxes, and all other expenses not specifically mentioned herein are the sole responsibility of the winner.
Sweepstakes Period: The Sweepstakes begins at 12:00 a.m. (EST) on July 17, 2019 and ends 11:59 pm (EST) July 31, 2019. Entrants are solely responsible for determining the corresponding time zone in their respective jurisdictions.
How to enter (limit one (1) entry per person regardless of entry method):
Via Online:
To enter, navigate the internet to http://www.stmarysbank.com/red-sox-sweepstakes and complete the online entry form.
Follow all instructions to complete and submit the online entry form. There is a limit of one (1) online entry via the online entry form per eligible person during the Sweepstakes Period described herein, regardless of the number of email addresses or accounts a person may have. Multiple entries in excess of this limitation or mass entry attempts will result in disqualification of all entries by such person. Entries must be manually key-stroked by the entrant; use of automated entry devices or programs, or entries by third parties, are prohibited. Incomplete entries will be disqualified. Proof of entering information at the Sweepstakes website or entry form is not considered proof of delivery to or receipt by Sponsor of such entry.
Via Mail:
To enter, mail a 3” x 5” card, hand-written in capital letters to include your legal name, legal address, city, state, ZIP, date of birth, day and evening phone numbers, and email (if available), along with the words “August 11, 2019 Red Sox Tickets” to Marketing Department, St. Mary’s Bank, 200 McGregor Street, Manchester, NH 03102. Mail-in entries must be received by Juluy 31, 2019 to be eligible for the random drawing. Proof of mailing does not constitute proof of delivery for the random drawing.
By entering, entrants agree to be bound by and acknowledge compliance with these Official Rules including eligibility requirements. Responsibility for receipt of entry rests solely with the entrant. Upon entry, all entries become Sponsor’s property. Sponsor will not be responsible for lost, misdirected or for technical, hardware, or software malfunctions; telephone failures; lost or unavailable network connections, or failed, inaccurate, incomplete, garbled, or delayed electronic communications; or for any human or mechanical error that may occur in the processing of the entries in the Sweepstakes. Sponsor reserves the right to cancel the Sweepstakes in Sponsor’s sole discretion. Sponsor will not acknowledge receipt of entries. All disputes shall be settled in the sole judgment of Sponsor. Limit one (1) entry per person regardless of entry method. Entries that are mechanically reproduced, copied, illegible, incomplete, or inaccurate and entries by means which subvert the entry process are void. Incomplete entries or entries not complying with these rules are subject to disqualification, at Sponsor’s sole discretion.
Eligibility: The Sweepstakes is open only to individuals who are legal residents of the fifty (50) United States (except for Rhode Island) or the District of Columbia and who are at least eighteen (18) years of age or older. If you are not a legal resident of the United States or you are not the required age as of time of entry, then you are not eligible to participate in the Sweepstakes or to win a prize. Employees, volunteer officials, affiliates, officers, directors, agents, and representatives of St Mary’s Bank, as well as immediate family of any employee (spouse, mother, father, sister, brother, daughter, or son) or member of the same household (whether related or not) of any employee, are not eligible to win. The Sweepstakes is void in Rhode Island and where prohibited and subject to all federal, state, and local laws and regulations.
By entry in the Sweepstakes, each entrant fully and unconditionally agrees to and accepts these Official Rules, the information provided on the promotional website, and the decisions of Sponsor (and their authorized representatives), which are final and binding with respect to all matters pertaining to the Sweepstakes and all elements thereof.
Drawing and Notification: One (1) winner will be selected in a random drawing among all eligible automatic and mailed-in entries received. The random drawing will be conducted by Sponsor on or about August 5, 2019. The winner will be notified by phone, email, or mail (or such other method as determined by Sponsor based on contact information provided in entering the Sweepstakes). The winner must contact Sponsor within two (2) business days from first notification attempt to confirm their eligibility to win and intent to claim the prize within the deadline specified for claiming the Prize herein. If the potential winner fails to contact Sponsor within the specified period, then such person shall forfeit the Prize and shall be disqualified and an alternate winner will be selected from the remaining pool of entries. The Prize may be reported to the Internal Revenue Service for tax purposes as required by law. Awarding of the Prize is subject to execution of Affidavit and Release forms by the winner, as well as providing valid government-issued photo identification. Failure of the winner to execute the Affidavit and Release forms or provide valid identification within the specified time period may result in winner’s forfeiture of the Prize and selection of an alternate winner(s) from remaining eligible entries.
Claiming Prize: Winners will be required to complete an Affidavit of Eligibility and Liability and Publicity Release when claiming the Prize. Winner must claim prize at the St. Mary’s Bank Headquarters located at 200 McGregor Street, Manchester, NH 03102 during regular business hours, and when claiming the Prize, winner must provide valid government-issued photo identification. Only the actual winner may claim the Prize, and the Prize is non-transferable by winner. Failure to timely claim the Prize will result in the forfeiture of the Prize, and the Prize will remain the property of Sponsor.
Prize Conditions: All federal, state, or other tax liabilities (including income taxes) arising from the Sweepstakes will be the sole responsibility of the winner. Except where prohibited by law, the winner’s entry and acceptance of the Prize constitutes permission for Sponsor to use said winner’s name, photograph, likeness, statements, biographical information, and voice, on a worldwide basis, in all forms of media without further compensation. The Prize may not be sold, traded, or rescheduled by winner. Sponsor’s decisions are final and binding on matters related to the Sweepstakes.
Sweepstakes Conditions: The Sweepstakes is subject to all applicable federal, state, and local laws. By participating, entrants agree to be bound by these Official Rules and the decision of Sponsor and waive any right to claim ambiguity in the Sweepstakes or these Official Rules. Sponsor may prohibit an entrant from participating in the Sweepstakes or winning a prize if, at its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, deception, or unfair playing practices or intending to annoy, abuse, threaten, or harass any other entrants or Sponsor representatives. If for any reason this sweepstakes is not capable of running as planned, including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, or any other causes beyond the reasonable control of Sponsor that corrupt or affect the administration, security, fairness, integrity or proper conduct of the promotion, then Sponsor reserves the right, at its sole discretion, to cancel the online entry portion of the Sweepstakes and to award all prize(s) by conducting a random drawing from all eligible entries received. ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS IN VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION.
Limitations of Liability: By participating in the Sweepstakes, entrants agree to the fullest extent permitted by law to release, discharge, indemnify, and hold harmless Sponsor and its officers, directors, employees, representatives, and agents (collectively, the “Released Parties”) from and against any claims, demands, or causes of action made by the entrants or any other third parties related in any way to the development or operation of the Sweepstakes, as well as any other claims, damages, or liability due to any injuries, damages or losses (whether alleged, threatened, or actual) to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any sweepstakes-related activity or participation in the Sweepstakes, whether or not caused by the negligence of one or more of the Released Parties.
Rules/Winner Information: To receive information on the winner or an additional copy of these Official Rules, mail a self-addressed, stamped envelope to St. Mary’s Bank, Marketing Department, 200 McGregor Street, Manchester, NH 03102. Please specify “Red Sox August 11 Game Ticket Winner” in your communication. Winner information will be available after August 11, 2019.
Applicable Law: These Official Rules shall, in all respects, be governed, construed, applied, interpreted, and enforced in accordance with the laws of the State of New Hampshire, excluding its choice of law rules or rulings.
